Contracts for the supply of digital content and Contracts for the online and other distance sales of goods
On 5 September, the European Commission will present the preliminary results of the REFIT exercise on consumer and marketing law, in particular in relation to the Consumer Sales and Guarantees Directive and the question as to whether the scope of the proposal on contracts for the online and other distance sales of goods (Rapporteur: Pascal Arimont, EPP) could/should be extended to face-to-face sales.

IMCO debate on Control of the acquisition and possession of weapons
IMCO committee gave on 5th September 2016 the green light for the opening of the negotiations with the EU Council on the Control of the acquisition and possession of weapons (revision of the Firearms Directive) by 24 votes for, 3 against and 5 abstentions. The trilogues are due to start at the end of September.

Working Group on the Digital Single Market
This report summarizes the discussion during the 8th Meeting of the IMCO Working Group on the Digital Single Market. It explains an exchange of views between MEPs, the European Commission and experts on the topic of boosting e-commerce and combating consumer discrimination in the Digital Single Market. The proceedings were prepared by Policy Department A for the Internal Market and Consumer Protection Committee.

On 18.11.2015, the EC adopted a legislative proposal for amending the 91/477 Directive on Firearms, together with the overdue evaluation report and Implementing Regulation on deactivation. Among others, the EC proposal contains stricter rules to ban certain semi-automatic firearms and for the online acquisition of firearms; includes museums and collectors in the scope of the Directive; amends the authorisation conditions for acquiring and possessing a firearm (e.g. provision of a medical test).

It also proposes common rules on marking of firearms for traceability purposes and strengthens the exchange of information between MS.

The proposal lacks an Impact Assessment. As mentioned in an implementation appraisal published by EPRS, "the revision of the Directive was initially included in the Commission Work Programme 2016 (Annex I, item 17). Following the terrorist attacks in Paris on 13 November 2015, the publication of the Commission proposal was brought forward..." together with the Implementing Regulation on deactivation standards.

The Directive was reviewed in 2008 (IMCO Rapp.: G. Kallenbach/ Greens) and foresaw that the EC would submit an evaluation report by 28.07.2015 on the situation resulting from the application of the Directive, together with any appropriate proposals.

The European Commission presented the preliminary results concerning the REFIT exercise on consumer law, in particular in relation to the Consumer Sales and Guarantees Directive and the question whether the scope of the proposal on online and other distance sales of goods could/should be extended to face-to-face sales of goods.

During the past months, the EC has gathered data from consumers and businesses through questionnaires inquiring about their expectations as regards guarantee periods and remedies available in case of lack of conformity.
Following an analysis of the data, the Commission was able to answer the question on the possible widening of the scope of the Sales of Goods Proposal to cover also face-to-face sales in the affirmative, leaving it however to the MEPs to table the necessary amendments to that effect.
