IMCO workshop on consequences of Brexit
The objective of this workshop is to provide a forum for discussion on possible consequences of Brexit on matters in competence of the Committee on the Internal Market and Consumer Protection.

The workshop aims to offer IMCO Members a possibility to discuss legal and economic implications of withdrawal of the UK from the EU, as well as scenarios for future cooperation between EU and UK.

Workshop will take place on Tuesday, 28 February 2017, from 10.00 till 12.30.

Contracts for the supply of digital content and Contracts for the online and other distance sales of goods
The proposed Directive aims at creating EU wide rules for faulty digital content in order to enhance consumer’s trust in the Digital Single Market and create legal certainty. Instead of having 28 different sets of rules for digital content sold online, harmonised rules will reduce the costs for traders and encourage them to expand cross-border. Together with the Directive on online and other distance sales of goods, the Digital Content proposal is presented as part of the Digital Market Strategy

The proposed Directive will help consumers benefit from a higher level of consumer protection notably through a reversal of burden of proof, supplier's liability for defects and right to terminate long-term contracts.

IMCO delegation to India - February 2017
A delegation of 7 MEPs will be send to India (Mumbai and New Delhi) to give a positive sign of commitment to common objectives within a revived EU-India strategic partnership. MEPs will look at the Indian customs policy (management of port controls), visit start-up incubators and Info-tech park, meet consumers associations to better understand how India safeguards consumers rights and combats counterfeiting, share experiences about the standardisation process in India and EU.

Contracts for the supply of digital content and Contracts for the online and other distance sales of goods
The sales of goods directive, including online and other distance sales, addresses consumer rights in case a good is defective. Currently there are only minimum EU requirements in place (Directive 1999/44/EC) and consequently in practise there are still different national laws, which would create legal uncertainty and affect consumers' confidence in cross-border shopping.

The proposed Directive fully harmonises, specifically for online and other distance sales, the order in which remedies are to be exercised and the duration of the legal guarantee, which would be fixed at two years throughout the EU. Also, the proposed text aims at reversing the burden of proof for two years.

study on reforming e-communications services: a critical assessment
This report analyses the proposed reform of the e-communications regulatory framework presented by the European Commission in September 2016. While many of the proposed changes appear meaningful, the report argues that overall the proposal does not entirely reflect the lessons learned from the past two decades of e-communications regulation in Europe, and ends up being at once too conservative...

(i.e. incremental with respect to legacy rules); fragile, since its effectiveness crucially depends on governance reform; and "retro", since it does not incorporate principles of flexible, adaptive regulation in its overarching framework. The report argues that the merits of a lighter, ex post approach to e-communications were not sufficiently gauged by the European Commission in its impact assessment.

The report was prepared at the request of Policy Department A and the IMCO Committee.
