study on An economic review on the Collaborative Economy
This paper provides an overview of the empirical evidence concerning the potential gains from collaborative economy and the economic impact some of its business models on. It discusses how we can distinguish professional and non-professional services and provides a list of 9 tentative recommendations for the better protection of the users of the collaborative platforms. It also summarises the main regulatory concerns that emerge from the operation of such platforms.

This document was prepared by Policy Department A at the request of the Committee on Internal Market and Consumer Protection.

study on scientific aspects underlying the regulatory framework in the area of fertilisers – state of play and future reforms
This document was prepared by Policy Department A at the request of the IMCO committee on the proposed cadmium regulation for phosphate fertilisers. Cadmium is a metal that can have adverse health effects on the general population. The use of mineral phosphate fertilisers contributes to about 60% of current cadmium emissions to soil. The proposed regulation aims to reduce soil and crop cadmium concentrations on the long term in most European regions.

The 2016 EC proposal revises the Consumer Protection Cooperation (CPC) Regulation 2006/2004 with the intention to improve the effectiveness of the rules and procedures on cooperation of national authorities responsible for the enforcement of consumer protection laws, in particular with the aim to better addressing the challenges of the Digital Single Market. The proposal for a Regulation (repealing Regulation 2006/2004) is part of the Commission’s e-Commerce package adopted on 25 May 2016.

The revised provisions would enhance the enforcement mechanisms used by the national authorities to address unlawful practices harmful to consumers in several countries, especially as regards online breaches.

Cooperation between national authorities responsible for the enforcement of consumer protection laws
At their extraordinary committee meeting on 13 March in Strasbourg, IMCO members will consider the compromise amendments on the report on cooperation between national authorisites responsible for the enforcement of consumer protection laws. They will also considerer the draft opinions on copyright in the Digital Single Market and Body of European Regulators for Electronic Communications.

IMCO debate on Control of the acquisition and possession of weapons
On 18.11.2015, the EC adopted a legislative proposal for amending the 91/477 Directive on Firearms, together with the overdue evaluation report and Implementing Regulation on deactivation. Among others, the EC proposal contains stricter rules to ban certain semi-automatic firearms and for the online acquisition of firearms; includes museums and collectors in the scope of the Directive; amends the authorisation conditions for acquiring and possessing a firearm (e.g. provision of a medical test).

It also proposes common rules on marking of firearms for traceability purposes and strengthens the exchange of information between MS.

The proposal lacks an Impact Assessment. As mentioned in an implementation appraisal published by EPRS, "the revision of the Directive was initially included in the Commission Work Programme 2016 (Annex I, item 17). Following the terrorist attacks in Paris on 13 November 2015, the publication of the Commission proposal was brought forward..." together with the Implementing Regulation on deactivation standards.

The Directive was reviewed in 2008 (IMCO Rapp.: G. Kallenbach/ Greens) and foresaw that the EC would submit an evaluation report by 28.07.2015 on the situation resulting from the application of the Directive, together with any appropriate proposals.

Control of the acquisition and possession of weapons
The European Parliament will discuss and vote on 14 March on the text agreed after four rounds of informal trialogue negotiations on the Firearms Directive. The co-legislators reached an initial political agreement on the revised text, including on the medical review provisions, the categorisation of high-capacity semi-automatic firearms, the provisions on high capacity magazines, the provisions on collectors, museums and target shooters, and the provisions on deactivation.

European Electronic Communications Code
In Sept. 2016, the EC put forward an ambitious overhaul of the EU telecoms rules with new initiatives to meet Europe’s growing connectivity needs and to encourage investment in high-capacity networks. The new European Electronic Communications Code puts forward simplified rules to increase competition and predictability for investments. It also aims to make better use of radio-frequencies by reducing divergences between regulatory practices and agreeing on a set of coordinated basic parameters.

The Code puts forward a revision of the sector-specific consumer protection rules and the universal services regime. It suggests new definitions of electronic communication services aiming to ensure a level playing field between traditional and new online market players.

ITRE is the lead committee dealing with the regulatory framework for Telecoms. IMCO has played a key role in shaping the regulatory framework for the electronic communication sector in Europe, with exclusive competence for all aspects related to consumer protection and universal services. In this recast, IMCO will continue to take the lead in deliberating which sector-specific rules should be in place to protect consumers and to ensure the universal availability of basic electronic communication services.
