Single market
On 29 November at 11h30 Members will held a joint debate with the European Commission on the legislative draft Report of Andreas Schwabon the governance on the single market that envisages to contribute to improving the legislation, transposition, implementation and application as well as the enforcement of the internal market regulatory framework.

The IMCO Committee is currently considering the Commission's proposals for a modernisation of the EU public procurement rules, including, more specifically, the revision of Directive 2004/18/EC ("Classic Directive") and of Directive 2004/17/EC ("Utilities Directive"). Public procurement is the process used by government institutions, public sector organisations and certain undertakings in the utilities sectors to buy supplies, services and public works. Such expenditure is a significant and influential component of the economy. The reform seeks to make the existing rules more flexible and easier to apply, to enable a greater strategic use of public purchasing power (to achieve green, social and innovation-related objectives) and to increase the use of new procurement techniques and tools such as joint buying and e-procurement. This work follows the adoption by the European Parliament of an IMCO own initiative report (rapporteur: Heide Rühle, Greens) in late 2011, in response to the Commission's Green Paper consultation.
 
The European Commission presented its proposal and the Impact Assessment to the IMCO Members on 9th January 2012. The first exchange of views took place on 29th February 2012.

Alongside the on-going reform of public procurement, the IMCO committee is currently considering a Commission proposal on concessions contracts. This initiative seeks to ensure a more efficient allocation of public money by establishing a single instrument regulating the competitive award of concessions contracts. The proposed rules seek to increase legal certainty for public authorities and to guarantee businesses effective access to the concessions markets across the EU.
 
The European Commission presented its proposal and the Impact Assessment to the IMCO Members on 25h January 2012. The first exchange of views took place on 29th February 2012.

IMCO Committee is dealing with the reform of the Professional Qualifications Directive. Some of the main elements of the proposal for modernisation consist of the introduction of a European professional card, better access to information and access to e-government services, modernisation of harmonised minimum training requirements, an alert mechanism for health professions, common training principles, mutual evaluation exercise on regulated professions, rules on partial access to a regulated profession and the clarification of the rules on language skills.
 
The European Commission presented its proposal and the impact assessments on the 9th of January and Members held a first exchange of view on the 28th of February. The Committee organized a hearing on the subject entitled "Growth & Mobility: Modernising the Professional Qualifications Directive" on the 25th of April. The members have held two considerations on the draft Report by the Rapporteur, on the 18th of September and the 10th of October. The deadline for amendments passed on the 15th of October, and the first consideration of amendments was held on the 6th of November. The Report of the Committee is expected to be adopted in Januaryof 2013.

The Committee held a second consideration of the amendments tabled to the draft Report and the Rapporteur presented some of the interim results of the discussions with the shadow Rapporteurs.  Shadow Rapporteurs elaborated on the particularities regarding the recognition of the qualifications of nurses and notaries, the dual education systems and the role of assistance centres in the recognition process. Further interventions focussed on the modalities of the alert mechanism for health professionals, the deadlines concerning tacit authorization and the costs of language checks to applicants. The compromise amendments are scheduled for discussion on January 10. The vote in IMCO is foreseen to take place on January 23.

Public procurement
Following the established cluster approach, also used in the Council discussions, compromise proposals for the following areas were considered: cluster 1 (simplification and flexibility of procedures); 4 (e-procurement); 7 (sound procedures); 8 (other procedural requirements) and 9 (governance). Shadows' generally expressed satisfaction with the results obtained, but some Groups were also concerned that more could have been done in order to reach simplification objectives. It was also noted that agreement on the more controversial issues such as social requirements, scope and conditions for public-public cooperations was still outstanding, and therefore some work was still ahead.
 
In the light of this, the Rapporteur also announced an update of the calendar, with a postponement of the vote on the classic directive from 29 November to 18 December, and of the utilities directive from 18 December to 24 January. In parallel, IMCO discussions will continue on related Commission proposals on the award of concession contracts (vote: 24 January) and an instrument for external access to EU public procurement markets (in association with INTA in the lead).

Highlights - The governance of the Single Market and the Annual Growth Survey - Committee on the Internal Market and Consumer Protection

Single market
In a joint debate, Members heard a presentation by the Commission of the first annual Report on the State of the Single Market Integration and considered amendments tabled to the draft initiative report of Andreas Schwab (EPP). The first edition of the Report seeks to reinforce the Single Market dimension in the Annual Growth Survey. The main barriers to a better Single Market functioning are identified in some key areas with the greatest growth potential, in particular: services, energy, transport and digital markets. Among the policy priorities, the Commission listed more ambitious implementation of the Services Directive, abolishment of the economic needs tests in the retail sector and improvement of the Points of Single Contact in services markets, as well as e-commerce, e-procurement and generally better implementation and enforcement of rules that are already in place.
 
Members welcomed the Commission's step towards reinforcing the Single Market dimension of the European Semester process which the Committee has been striving for in a number of its recent reports, and notably in the Schwab initiative report on governance. However, Members felt that the Commission should have better responded to Parliament's requests relating the annual Single Market governance cycle. Many Members also felt that not enough was done by the Commission to ensure that the full Single Market growth potential is unlocked and remaining obstacles to further integration removed by Member States.
 
IMCO committee will present its views on the Single Market dimension of the 2013 Annual Growth Survey and on the first edition of the Report on the state of the Single Market integration within in Schwab report. For this purpose, a supplementary deadline for amendments to the Schwab report was set on 6 December 2012.

Completing the digital single market
At their Plenary on 10 December in the afternoon Members will debate the own INI report of Pablo Arias Echeverría on Completing the digital single market. The report focuses inter alia on the new Single Market Act II and the equal access to the Digital Single Market. The vote will take place on 11 December at noon.
