EU shoppers who have disputes with traders over goods and services may no longer need to go to court to settle them, thanks to a deal struck by Parliament and Council negotiators. The deal, on two laws to protect online and cross-border shoppers, aims to give easy access to fast, cheap and fair ways of settling disputes.

On 17 December PM Members will consider the draft report of Vicente Garcés Ramón on a new agenda for European Consumer Policy. Ensure safe food, health and product safety, lower inequalities between consumers in Europe, contribute to a low carbon economy and protect children from advertising should be priorities in the Consumer Agenda.

Alternative dispute resolution schemes usually use a third party such as an arbitrator, mediator or an ombudsman to help the consumer and the trader to reach a solution in case of a dispute. Their advantage is offering more flexibility than going to court and better meeting the needs of both consumers and professionals. Compared to a court case these schemes are cheaper, quicker and more informal.

In view of the fact that these out-of-court mechanisms have been developed differently across the European Union and that consumers often refrain from cross-border purchases because of uncertainty about who to turn to in case of a problem with a foreign trader, the need for regulatory action at the European level was identified.

IMCO is currently working on two legislative proposals related to alternative dispute resolution (ADR): a Directive on ADR that aims to ensure that quality out-of-court entities exist to deal with any contractual dispute between a consumer and a business, and a Regulation on online dispute resolution (ODR) that would establishing a European ODR platform offering a single point of entry to those who seek to resolve a dispute which has arisen from a cross-border e-commerce transaction.

At their Plenary in December, Members debated and voted on the own INI report of Pablo Arias Echeverría on Completing the digital single market. The report focuses inter alia on the new Single Market Act II and the equal access to the Digital Single Market.

Public procurement contracts should go to the most "advantageous" bidder, assessed on environmental or social criteria, not just the lowest one, said Internal Market MEPs voting on new EU rules on Tuesday. MEPs also improved an optional "innovation" provision, to enable bidders to suggest how best to meet specifications set out in the contract.
