Press release - MEPs back paper-free EU customs union with targeted funding - Committee on the Internal Market and Consumer Protection

The EU customs union must not become a "two-speed" one, in which some member states enable businesses to complete customs formalities electronically, but others require them to do so on paper, said the Internal Market Committee on Tuesday. The committee also amended a proposed customs "action plan" to help member states to acquire high-tech equipment such as scanners.

Alternative and online Dispute Resolution
Following the successful conclusion of the informal trialogues on 5 December and the receipt of a formal letter from Coreper with the accepted text of both legislative instruments, the Committee endorsed the outcome of negotiations by 35 votes in favour, 4 against, no abstentions. IMCO has thus adopted 3 of the important actions of the Single Market Act before the end of 2012. The Rapporteur for ADR considered it nevertheless important to draw Members' attention to a certain phrase in one of the Recitals (allowing the ADR entities to extend the 90-day period to solve the dispute "for justified grounds vested in the sphere of the parties to the dispute") which will need to be carefully examined by the lawyer-linguists of both institutions (Parliament and Council) in order to ensure legal clarity and consistency with the corresponding Article (where this phrase does not appear).

A new agenda for European Consumer Policy
The Rapporteur calls for consumers to be able to exercise their rights simply and effectively in basic areas relating to food, financial and digital services, energy and health. He stresses that e-commerce needs to ensure the quality of products and that vulnerable groups of the population such as children and the elderly needs special attention. The Rapporteur emphasises the importance of the current financial crisis regarding both the economic as well as the social context as this affects consumers' confidence.
 
Several comments were made as regards the need for strengthening enforcement mechanisms, the importance to progress on the collective redress initiative and on the situation of European consumers in a wider global context where services and goods go beyond the EU frontiers. Further clarification of certain recommendations is still needed. Consequently, it was decided to postpone the deadline for amendments from 10 January to 22 January 2013.

Public procurement
IMCO Members voted on the report of M. Tarabella on the proposal for a Directive Public Procurement. The Report was adopted with 23 votes in favour, 8 against and 7 abstentions. Approximately 150 amendments were adopted, out of which 90 compromise amendments reached between Shadows and the Rapporteur.
 
In total, 92 compromise amendments had been reached, which ensured a smooth voting process. The compromises adopted include, a general principle on social and environmental considerations; on life-cycle costing; on subcontracting; on public-public cooperation and on exclusions as well as on the 'light regime' for social services.
 
While the Rapporteur stated his satisfaction with the outcome of the vote and the work done between the Shadows, some Groups expressed concerns with regard to the final outcome of the vote. In particular, they mentioned the lack of simplification achieved and stressed that more could be done to increase legal certainty for contracting authorities and access to public procurement for SMEs.
 
Regarding future steps, the Directives on utilities and concessions will be put to vote in IMCO on 24 January 2013. IMCO coordinators will decide at a later stage whether to open negotiations with the Council for a first-reading agreement or to submit the IMCO report to plenary.

The IMCO Committee is currently considering the Commission's proposals for a modernisation of the EU public procurement rules, including, more specifically, the revision of Directive 2004/18/EC ("Classic Directive") and of Directive 2004/17/EC ("Utilities Directive"). Public procurement is the process used by government institutions, public sector organisations and certain undertakings in the utilities sectors to buy supplies, services and public works. Such expenditure is a significant and influential component of the economy. The reform seeks to make the existing rules more flexible and easier to apply, to enable a greater strategic use of public purchasing power (to achieve green, social and innovation-related objectives) and to increase the use of new procurement techniques and tools such as joint buying and e-procurement. This work follows the adoption by the European Parliament of an IMCO own initiative report (rapporteur: Heide Rühle, Greens) in late 2011, in response to the Commission's Green Paper consultation.
 
The European Commission presented its proposal and the Impact Assessment to the IMCO Members on 9th January 2012. The first exchange of views took place on 29th February 2012.
