The Directive 2006/114/EC on Misleading and Comparative Advertising (MCAD) is a horizontal directive which applies, as regards misleading advertising, in business-to-business (B2B) relations, and - in the case of comparative advertising - to B2B and business-to-consumer (B2C) relations. The MCAD specifically aimed to provide traders with protection against misleading advertising, but apparently failed to prevent the activity of the so-called directory companies, which pretend to offer gratuitous listing to businesses and then charge them with high annual costs.

Members considered the amendments to the draft report, including a number of compromise proposals prepared by the Rapporteur. Among the issues raised were: a blacklist of misleading marketing practices as well as that of companies repeatedly convicted for them; cooperation of national enforcement authorities with such institutions as banks, posts and debt-collection agencies; provisions on collective redress in national laws; and evaluation of the possibility to extend the Unfair Commercial Practices Directive. The Commission representative was supportive of the direction of the compromise amendments and made certain comments towards the others. The vote is planned for 26 September.

The IMCO Committee is currently considering the Commission's proposals for a modernisation of the EU public procurement rules, including, more specifically, the revision of Directive 2004/18/EC ("Classic Directive") and of Directive 2004/17/EC ("Utilities Directive"). Public procurement is the process used by government institutions, public sector organisations and certain undertakings in the utilities sectors to buy supplies, services and public works. Such expenditure is a significant and influential component of the economy. The reform seeks to make the existing rules more flexible and easier to apply, to enable a greater strategic use of public purchasing power (to achieve green, social and innovation-related objectives) and to increase the use of new procurement techniques and tools such as joint buying and e-procurement. This work follows the adoption by the European Parliament of an IMCO own initiative report (rapporteur: Heide Rühle, Greens) in late 2011, in response to the Commission's Green Paper consultation.

The European Commission presented its proposal and the Impact Assessment to the IMCO Members on 9th January 2012. The first exchange of views took place on 29th February 2012.

Alongside the on-going reform of public procurement, the IMCO committee is currently considering a Commission proposal on concessions contracts. This initiative seeks to ensure a more efficient allocation of public money by establishing a single instrument regulating the competitive award of concessions contracts. The proposed rules seek to increase legal certainty for public authorities and to guarantee businesses effective access to the concessions markets across the EU.

1st Retail Market Roundtable: for a more efficient and fairer retail market in Europe

On 26.09, IMCO will organise its 1st annual retail market roundtable. In line with the 2011 resolution on a more efficient and fairer retail market (Corazza Bildt Report), this will be an opportunity to continue the dialogue with stakeholders, throughout the supply chain, in order to develop a more efficient and competitive single market in retail, to unleash the sector's potentials in stimulating growth, job creation and consumer access to cross-border services.
