Many payments in commercial transactions between businesses or between business and public authorities are made much later than agreed, which is costly for businesses, and disrupts the functioning of the internal market. Parliament insisted that the Commission should take appropriate action when Directive 2000/35/EC was adopted to combat late payments, and IMCO took part in revising it during this term, with the Legal Affairs Committee providing an opinion under Rule 50.
 
The main provisions of the new Directive 2011/7/EU include harmonisation of the payment period by public authorities and enterprises (within 60 days) and compensation for recovery costs and statutory interest rate of at least 8%. IMCO Members strongly supported the Commission's proposal because it aimed to improve the functioning of the internal market during the financial crisis and especially the situation of SMEs. At the moment of writing this Welcome pack, the Commission was checking the correct transposition and implementation of the new directive in the Member States, as it had to be transposed into national law by 16 March 2013.

To help mitigate the consequences of serious road accidents, the EU has committed to putting in place an emergency call system known as eCall. Based on in-vehicle communication technology, such an electronic safety system will automatically call emergency services in case of a serious crash. The eCall will dial 112 - the Europe's single emergency number and communicate the vehicle's location to emergency services, even if the driver is unconscious or unable to make a phone call. It is estimated that it could save up to 2500 lives a year.
 
To achieve that objective, on 13 June 2013 the Commission presented two legislative proposals aimed at ensuring that, from 1 October 2015, firstly, all new models of passenger cars and light duty vehicles would be fitted with 112 eCall and, secondly, the necessary infrastructure would be created for the proper receipt and handling of eCalls in emergency call response centres - ensuring the compatibility, interoperability and continuity of the EU-wide eCall service.
 
These proposals have been requested by the Parliament, in particular, in its resolution of 3 July 2012 on e-Call: a new 112 service for citizens (IMCO-TRAN report under Rule 51 by Olga Sehnalová and Dieter-Lebrecht Koch).
 
Out of the two proposals, the one concerning the deployment of the necessary infrastructure is discussed by the TRAN Committee, with Philippe De Backer (ADLE) as Rapporteur, while the IMCO Committee is the lead committee for the proposal concerning the in-vehicle equipment - the proposed regulation on type-approval requirements for the eCall in-vehicle system and amending Directive 2007/46/EC.
 
The proposal for a regulation provides for the mandatory introduction of an eCall in-vehicle system in new type-approved vehicles across the EU. Contrary to the current system where eCall is installed by manufacturers on a voluntary basis, the proposal provides for a mandatory fitting of eCall devices in vehicles, starting with new passenger cars and light commercial vehicles, by 1 October 2015. It therefore requires vehicle and equipment manufacturers to ensure that, in the event of a severe accident, an eCall to 112 is activated automatically. An eCall can also be triggered manually. Furthermore, the regulation provides for rules on privacy and data protection, as well as for the delegation of powers to the Commission in respect of detailed technical requirements.
 
The IMCO Committee is currently considering the Commission proposal.

Electronic invoicing in public procurement
The IMCO Committee has considered the Commission's proposal on electronic invoicing ('e-invoicing') in public procurement. The proposal seeks to establish a common EU-wide standard for e-invoices that all contracting authorities and entities must accept, even though they may continue to use other national standards and systems. This complemented the package for the modernisation of the EU public procurement rules, adopted in plenary in January 2014, which makes use of e-procurement procedures mandatory by 2018. The proposal is also one of the first to apply standardisation regulation 1025/2012/EU.
 
Public procurement is the process used by government institutions, public sector organisations and certain undertakings in the utilities sectors to buy supplies, services and public works. Such expenditure is a significant and influential component of the economy. The procurement package strengthens the rules for electronic procurement, making its use mandatory at the latest 54 months after the entry into force of the revised instruments. Moving towards more efficient paperless procedures is expected to yield great benefits. However, the modernisation package does not cover the 'post-award' stage of invoicing, because it is not procurement-specific. The e-invoicing directive seeks to fill this gap, as e-invoicing in particular is expected to generate tangible financial savings for government and suppliers, and to promote digital business transactions throughout the EU, by ensuring that there are no interoperability barriers to cross-border trade.
 
The European Commission presented its proposal and the accompanying Impact Assessment to IMCO Members on 30 September 2013. This was followed by an exchange of views on 4 November 2013 and the consideration of both, amendments and compromise amendments on 16 December 2013. On 17 December 2013, IMCO adopted the proposal by 37 votes in favour, and gave the green light to opening informal trilogue negotiations with the Council. The negotiations were successfully concluded at early first reading with the confirmation of the agreement by COREPER I at the end of January 2014 and IMCO endorsement on 11 February. The adoption in plenary is scheduled for March 2014.

The Alignment Package consists of nine directives being aligned to the 'New Legislative Framework' (NLF) which was adopted as part of the goods package from 2008, in particular decision No 768/2008/EC establishing a common framework for the marketing of products. The NLF sets out the reference for future product legislation and the 9 directives were chosen as they were not foreseen for revision in the coming years. The directives were aligned to the NLF through a recast technique, seeking to focus only on changes that were a direct result of the alignment procedure without going into substantive changes that would require longer preparations.
 
The final agreement with the Council leads to less red tape for economic operators, better market surveillance and clearer labels for consumers. The most sensitive issue during the informal negotiations with the Council was the Council's wish for adding committee procedures to all the directives.
 
The Directive on Pressure Equipment was separated from the Alignment package presented in November 2011 because, unlike the other nine Directive, this recast also contained an alignment with another EU legislative act, namely Regulation (EC) No 1272/2008 (CLP Regulation) of the EP and of the CEU of 16 December 2008 on classification, labelling and packaging of substances and mixtures. The intention of the proposal was restricted to a pure alignment with the horizontal provisions in Decision 768/2008/EC and CLP Regulation as well as the new terminology within the Lisbon Treaty, including new rules on Comitology.
 
The IMCO Members supported the Commission's general intention of a pure alignment and had therefore limited their amendments to the EC proposal to changes reflecting the agreement obtained between the Council and the Parliament on the nine other Directives and which had been omitted in the proposal. The Greek Presidency got a mandate on 22 January and the second trialogue was held on 5 February 2014.

On 13 February 2013 the European Commission adopted a comprehensive package on Product Safety and Market Surveillance in order to improve safety of consumer products, in particular by strengthening product identification and traceability, and to simplify and improve the framework of market surveillance of products, particularly by eliminating currently existing overlaps and inconsistencies. The package, which is a key action of the Single Market Act II, consists of two legislative initiatives: a proposal for a new Regulation on Consumer Product Safety and a proposal for a single Regulation on Market Surveillance of Products, as well as complimentary non-legislative measures, in particular multi-annual plan for market surveillance setting out 20 actions to be implemented until 2015 to make progress in market surveillance.
 
Two legislative proposals and the accompanying impact assessment have been presented in IMCO Committee on 7 May 2013 and Members held a first exchange of view at the same day. The Committee is organizing a hearing on the subject entitled "Safe Products and a Fair Market: Challenges and Opportunities" on the 29 May 2013.

The IMCO Committee has considered the Commission's proposals for a modernisation of the EU public procurement rules (rapporteur: Marc Tarabella, S&D). This included the revision of Directive 2004/18/EC ("Classic Directive") on procurement by public authorities, and of Directive 2004/17/EC on procurement by entities operating in the water, energy, transport and postal services sectors ("Utilities Directive"), as well as a new instrument for the award of concessions contracts. This was further complemented by the adoption of an international procurement instrument ('IPI') on access to and from third country procurement markets, conducted jointly by IMCO and INTA.
 
Public procurement is the process used by government institutions, public sector organisations and certain undertakings in the utilities sectors to buy supplies, services and public works. Such expenditure is a significant and influential component of the economy. The reform aimed to make the existing rules more flexible and easier to apply, to enable a greater strategic use of public purchasing power (to achieve green, social and innovation-related objectives) and to increase the use of new procurement techniques and tools such as joint buying and e-procurement. The basic challenges had already been debated in two IMCO own initiative reports (rapporteur: Heide Rühle, Greens), adopted in plenary in 2010 and 2011, in response to the Commission's Green Paper consultation.
 
The parliamentary works were completed within a period of 2 years: The European Commission presented its proposal and the Impact Assessment to the IMCO Members on 9 January 2012, followed by a first exchange of views on 29 February 2012. The negotiations were successfully concluded at first reading with the confirmation of the agreement by COREPER I in July 2013 and IMCO endorsement on 5 September 2013. The full modernisation package was adopted by Parliament in a plenary vote on 15 January 2014, and by Council on 11 February 2014. Amendments had been considered on 18 September and 5 November 2012, and compromise amendments on 28 November 2012. On 18 December 2012 and 24 January 2013, IMCO adopted its reports on, respectively, the classic and the utilities proposals (Classic Directive: 23 votes in favour, 8 against and 7 abstentions; Utilities Directive: 25 votes in favour, 5 against and 8 abstentions). Informal trilogue negotiations with the Council then lasted from February until July 2013.
