EU citizens still do not benefit fully from the single market, said MEPs in a resolution adopted on Tuesday. They point to difficulties opening bank accounts, registering cars and having professional qualifications recognized and blame these problems on member states' reluctance to implement EU rules swiftly, coordinate with each other and inform citizens of their rights.

Highlights - Public hearing - Common European Sales Law: Good choice for the consumer? - Committee on the Internal Market and Consumer Protection

On 24 September, IMCO Committee held this public hearing within the framework of preparation of its opinion under Rule 50 to JURI's report on the Common European Sales Law. Following an introduction on the present state of consumer contract law made by Prof. Stuyck from KU Leuven, Members listened to presentations made by Ms Goyens (BEUC), Mr Seifert (Oldenburg Chamber of Commerce and Industry), Mr Warner (WHICH?), and Dr Bellinghausen (Linklaters).
 
The experts interventions allowed a better understanding of the perspective of consumer and business organisations towards this controversial legislative proposal. A special focus was made with regard to the right of withdrawal, as proposed in the Common European Sales Law, in comparison to the recently adopted Consumer Rights Directive. A lively debate, including questions put forward by other representatives of consumer organisations present in the meeting room, and interventions from the European Commission, followed.

Highlights - Better Governance for the Single Market - Committee on the Internal Market and Consumer Protection

The Rapporteur, Andreas Schwab (EPP - DE), presented his preliminary proposals that could be included in the own-initiative report, stressing the need to complete and improve the functioning of the Single Market in order to deliver growth, to ensure effective implementation of the rules, to make the Commission procedures with regard to the implementation of the internal market acquis by the Member States more transparent, and to speed up the procedures before the Court of Justice were in his view among the key priorities. He also underlined the importance of making the use of the European Semester process to monitor the functioning of the Single Market. Members expressed similar views on the importance of ensuring transparency, giving clearer guidelines to the Member States, achieving better uniformity in the implementation (while preserving country-specific diversity), the need to agree on an EU "growth plan" where the Single Market has a key role to play. The Rapporteur also indicated the need for the Parliament to adopt a legislative own-initiative report relating to Single Market governance.
 
Director Emer Daly (DG MARKT) presented the key messages from the Commission Communication on Better Governance for the Single Market. She focused on the key areas for growth where the Commission identified 40 internal market Directives where swift delivery would most contribute to boosting growth and consumer and business confidence, and concrete measures to further improve the way Single Market rules are implemented, applied and enforced.

Following a short discussion on the compromise amendments proposed by the Rapporteur, Regina Bastos (EPP - PT), and broadly agreed upon by Shadows, the Committee adopted the own-initiative report on European citizens' and business' 20 main concerns with the functioning of the Single Market by unanimity.
 
The final report, which is going to be put to EP plenary in October, considers that EU citizens still do not benefit fully from the internal market and have difficulties inter alia with opening bank accounts, registering cars and having professional qualifications recognized in another Member State. In conclusion, the report calls on Member States to implement the EU rules swiftly and properly, to coordinate with each other and to inform citizens of their rights. IMCO also calls on the Commission to undertake a number of measures in order to solve the identified problems and also to continue the monitoring exercise.

Mr. A. Jessen (DG Trade) and Mr. J. Robberecht (DG Markt) presented the relevant proposal for a Regulation and the accompanying impact assessment, focusing mainly on the rationale, the objectives and the policy options. The proposal was prompted by the need to improve EU access to third country procurement markets and increase the Union's leverage in international negotiations. Moreover, the instrument of a Regulation, remedies the current fragmentation of the internal market and, hence, guarantees legal certainty for third country access in the Union's procurement market. Finally, the Commission clarified that the proposal establishes the principle of openness as the default rule, while the possibility of contracting authorities to exclude foreign bids or the possibility of the Commission to adopt proportional restrictive measures are essentially exceptional mechanisms.
 
Members overall supported the rationale and objectives of the proposal - i.e. to ensure the reciprocal openness of third country procurement markets - but expressed doubts as to the practicality of its implementation, especially taking into account the limited resources and expertise of national authorities. Concerns were equally raised regarding the protectionist character of the proposed Regulation and the distorted signal which the EU risks communicating to its trading partners.

The IMCO Committee is currently considering the Commission's proposals for a modernisation of the EU public procurement rules, including, more specifically, the revision of Directive 2004/18/EC ("Classic Directive") and of Directive 2004/17/EC ("Utilities Directive"). Public procurement is the process used by government institutions, public sector organisations and certain undertakings in the utilities sectors to buy supplies, services and public works. Such expenditure is a significant and influential component of the economy. The reform seeks to make the existing rules more flexible and easier to apply, to enable a greater strategic use of public purchasing power (to achieve green, social and innovation-related objectives) and to increase the use of new procurement techniques and tools such as joint buying and e-procurement. This work follows the adoption by the European Parliament of an IMCO own initiative report (rapporteur: Heide Rühle, Greens) in late 2011, in response to the Commission's Green Paper consultation.
 
The European Commission presented its proposal and the Impact Assessment to the IMCO Members on 9th January 2012. The first exchange of views took place on 29th February 2012.
