The US EPA issued on 18 September a notice of violation of emissions limits against Volkswagen due to a variety of models of diesel car emitting up to 40 times more pollution than emission standards allow. Volkswagen has admitted having fixed the tests for diesel emissions levels in the US market through "defeat devices" that cheat the emissions test for nitrogen oxides. ENVI, IMCO, ITRE and TRAN jointly draft an OQ to the EC to assess whether European testing regimes have also been affected.

Investor-State Dispute Settlement (ISDS) clauses in international investment agreements have traditionally been based on an approach which may be termed ‘light touch regulation’ of investment protection. The avenue taken by the recently negotiated EU draft agreements, the Comprehensive Economic and Trade Agreement (CETA) and the EU-Singapore Free Trade Agreement (EUSFTA), can be described as ‘more comprehensive regulation’. Likewise, EUSFTA and CETA provide a rather detailed body of law on substantive standards for the protection of foreign investment. While this may add to the clarity and predictability of the current regime of international investment law, it may also lead to a reduced standard of protection. Compared with other agreements, EUSFTA and CETA have attempted to rebalance the protection of private property and the host state’s regulatory autonomy. In terms of the regulation of ISDS proceedings, EUSFTA and CETA preserve its principle characteristics but deliver moderate change in five areas: (1) consultation mechanisms, (2) the relationship between ISDS and domestic remedies, (3) the appointment and conduct of arbitrators, (4) cost allocation, and (5) transparency rules. This study proposes (1) further development regarding the coordination between effective domestic legal systems and ISDS and (2) the start of negotiations for the establishment of a permanent appeals mechanism in a regional or bilateral context.

Union Customs Code Delegated Act
The Union Customs Code (UCC) was adopted in 2013 and will become applicable as from 1 May 2016 subject to appropriate supplementing and implementing acts being put into place. These acts together with the UCC form a legal package which aims to improve the functioning of the EU customs union as a whole by enhancing the uniform application of the customs regulation throughout the customs territory of the EU by the Member States’ national customs services.

Customs infringements and sanctions
Despite the fact that customs legislation is fully harmonised, its enforcement and the lawful imposition of sanctions lie within the ambit of Member States' national law. On 13.12.2013, the Commission published a proposal for a Directive on a Union legal framework on customs infringements and sanctions with the objective of an effective implementation of customs law and its enforcement in the EU’s customs union.

Towards a Digital Single Market Act
On 13 October PM, the first joint IMCO/ITRE meeting (rule 55) on the INI Report "Towards a Digital Single Market Act" will take place in the Hemicycle. This strategic report will provide the EP response to the DSM Strategy launched by the Commission in May. JURI, LIBE, CULT and EMPL will be associated Committees (rule 54), TRAN and ECON will also give an opinion (Rule 53). The vote is foreseen to take place in December.

Package travel and assisted travel arrangements
Following the consideration of the Council position at first reading on the proposal in subject of 12 October 2015, the IMCO Committee adopted by 29 votes in favour and 2 against the draft recommendation for second reading, proposing to approve the Council position at first reading without amendments. The position of the Council at first reading reflects the agreement reached in informal trialogues and corresponds to the text endorsed in IMCO on 4 June 2015.

Torecall, the new Directive aims at ensuring that package holidays, consisting ofa flight, hotel or car hire, put together online by travellers will get the same protection as the ones prepared by traditional travelagents. Before concluding a contract, holidaymakers will have to be informed ifthey are buying a package and who will be responsible if something goes wrong.Travellers also get a right to cancel a package if its price rises by more than8%, and if "unavoidable" and"unforeseen" events such as natural disasters or terrorist attacksmake it impossible for travellers to return home on time, the organiser wouldhave to pay for a stay of three nights.
