On 6 November, Mr Pierre Chastanet (Head of “Cloud and Software” Unit at DG CNECT) updated Members on the implementation of the Free Flow Regulation, which entered into force in November 2018. The Regulation bans data localisation measures. Mr Chastanet reported that Member States are currently screening national legislation to identify any data localisation measures, which would have to be repealed and explained the Commission’s guidance on the interaction of this Regulation and the GDPR.
He also explained that industry would publish data portability codes of conduct later this month.
In the debate that followed, Members raised questions touching upon all three elements of the Commission's presentation, encouraged the Commission to ensure Member State compliance with this Regulation.
