IMCO committee has adopted the NIS report by 33-1-1. Members also mandate the rapporteur (31-1-0) to start the negotiations with the Council. All the compromise amendments have been adopted. In essence, the definition of market operator has been widened to incorporate financial market infrastructure and food supply chain. While the Rapporteur has decided not to include internet society providers and public administration into the scope of the directive, it would still be of relevance to keep internet exchange points under the obligations of the directive. Public administration, in turn, would be able to adopt the requirements on a voluntary basis. In addition, cooperation between the authorities competent in the field of network and information security would be strengthened as, drawing on services directive, the Member States will be obliged to assign single points of contact for cross-border cooperation. It is also important to note that data protection obligations have been considerably strengthened, especially in the international aspect of cyber security. The report will be voted in Plenary in March.
