On 3 October 2017, the Commission presented a package of two Communications and one Recommendation in the area of public procurement and launched a consultation aiming to collect feedback from stakeholders on how to stimulate innovation through the procurement of goods and services. The first Communication sets out the priority areas for improvement in the area of public procurement both at Member State and Commission level.

The second Communication concerns the voluntary ex-ante assessment of large infrastructure projects.
The Recommendation on professionalization of public buyers provides for steps to be taken by Member States.

IMCO will prepare an own-initiative report on the Public Procurement Strategy package (Rapporteur: Carlos Coelho (EPP)). The report may respond to the above Communications and initiatives of the Commission, commenting on what is necessary for the implementation of the EU public procurement legislation and policy and drawing attention to the challenges ahead, including that of achieving end-to-end electronic procurement by the end of 2018.

At their Plenary sitting in Strasbourg, Members will discuss on 5 and vote on 6 Feruary the legislative report on geo-blocking and other forms of discrimination based on customers' nationality, place of residence or place of establishment. The regulation on geo-blocking seeks to provide more legal certainty and enforceability by defining specific situations when there can be no justified reason for discrimination on the grounds of nationality/residence.

It also bans the blocking of access to websites and the use of automatic re-routing without the customer's prior consent; and includes provisions of non-discrimination within accepted payment means.

This paper looks at liability of online providers for copyright infringements. The liability privileges in Articles 12 to 15 E-Commerce Directive can remain unchanged; they seem to be sufficiently flexible to adopt to new business models, which also make them in general future proof. These privileges do not, however, establish liability. With regard to injunction claims, Article 8(3) Copyright Directive provides for a satisfactory solution. EU rules establishing liability beyond injunction (e.g. damages) should be harmonised following the requirements (1) sufficient intervention by the internet provider and (2) breach of an adequate duty of care by the internet provider.

A delegation of the Committee on Internal Market and Consumer Protection will go to Madrid to discuss the Digital Single Market strategy and the on-going implementation of the web accessibility directive. The delegation will also look into initiatives to boost the market for accessible products and services, in the context of the on-going negotiations of the EU legislative proposal on accessibility of products and services in the internal market. The mission will take place from 12.02-14.02.18.

The report on geo-blocking and other forms of discrimination based on customers' nationality, place of residence or of establishment, tabled by the Committee on Internal Market, will be discussed and voted by Parliament on 05-06.02.18. Amongst other things, the proposed regulation defines situations when there can be no justified reason for discrimination on grounds of nationality or residence, and bans the blocking of access to websites and the use of automatic re-routing without prior consent.

As part of its eCommerce package, the EC presented on 25.05.16 a proposal for a regulation on addressing geo-blocking and other forms of discrimination based on customers' nationality, place of residence or place of establishment. The purpose of the regulation is to ensure that customers have the same access to goods and services as local customers. The Regulation builds upon the provisions of the Services Directive (Art 20), which already establishes the principle for non-discrimination,

but has proven difficult to enforce in practice due to legal uncertainty concerning what practices would or not be considered justified.

The regulation seeks to provide more legal certainty and enforceability by defining specific situations when there can be no justified reason for discrimination on the grounds of nationality/residence. It also bans the blocking of access to websites and the use of automatic re-routing without the customer's prior consent; and includes provisions of non-discrimination within accepted payment means.

Council adopted its negotiating mandate in November 2016. Parliament, led by IMCO, is currently going through its first reading.
