Highlights - Hearing of Commissioner-designate for Health and Consumer Protection - Committee on the Internal Market and Consumer Protection

Tonio Borg - Commissioner-designate
The new Commissioner-designate for Health and Consumer Protection, Mr Tonio Borg, was heard by MEPs upon invitation by the ENVI Committee, in association with the IMCO and AGRI committees. Mr Borg, currently Deputy Prime Minister and Minister of Foreign Affairs of Malta, was nominated to take over this portfolio following the resignation of Mr John Dalli. The hearing took place on 13.11.12, from 15.00, and was webstreamed.

Tonio Borg - Commissioner-designate
On 13 November from 15:00 to 18:00, Mr Tonio Borg, Commissioner-designate for Health and Consumer Protection, will be heard by the Committee on Environment, Public Health and Food Safety Committee, in cooperation with the Committee on Internal Market and Consumer Protection and the Committee on Agriculture. The Council had informed Parliament of its intention to appoint Mr Borg on 25 October 2012, following the resignation of former Commissioner Mr John Dalli.
 
As provided for by Article 246 of the Treaty on the Functioning of the EU, a vacancy caused by resignation shall be filled for the remainder of the Member’s term of office by a new Member of the same nationality only after consulting the European Parliament.
 
According to Rule 106 of Parliament's Rules of Procedure, the appropriate committee or committees shall invite the Commissioner-designate to a three-hour hearing organised in such a way as to enable Commissioners-designate to disclose to Parliament all relevant information.
 
Before the hearing takes place, the Commissioner-designate communicates his curriculum vitae as well as his declaration of interests and replies to written questions submitted by the committees.
 
After the hearing, committees proceed with an evaluation which is conveyed to the Conference of Committee Chairs and, subsequently, to the Conference of Presidents, which shall declare the hearings closed.
 
It is then up to the Parliament's plenary to vote on the appointment of the Commissioner by secret ballot.

The IMCO Committee is currently considering the Commission's proposals for a modernisation of the EU public procurement rules, including, more specifically, the revision of Directive 2004/18/EC ("Classic Directive") and of Directive 2004/17/EC ("Utilities Directive"). Public procurement is the process used by government institutions, public sector organisations and certain undertakings in the utilities sectors to buy supplies, services and public works. Such expenditure is a significant and influential component of the economy. The reform seeks to make the existing rules more flexible and easier to apply, to enable a greater strategic use of public purchasing power (to achieve green, social and innovation-related objectives) and to increase the use of new procurement techniques and tools such as joint buying and e-procurement. This work follows the adoption by the European Parliament of an IMCO own initiative report (rapporteur: Heide Rühle, Greens) in late 2011, in response to the Commission's Green Paper consultation.
 
The European Commission presented its proposal and the Impact Assessment to the IMCO Members on 9th January 2012. The first exchange of views took place on 29th February 2012.

Alongside the on-going reform of public procurement, the IMCO committee is currently considering a Commission proposal on concessions contracts. This initiative seeks to ensure a more efficient allocation of public money by establishing a single instrument regulating the competitive award of concessions contracts. The proposed rules seek to increase legal certainty for public authorities and to guarantee businesses effective access to the concessions markets across the EU.
 
The European Commission presented its proposal and the Impact Assessment to the IMCO Members on 25h January 2012. The first exchange of views took place on 29th February 2012.

During the plenary sitting of 21.11.12, in Strasbourg, Members approved the nomination of Mr Tonio Borg as new Commissioner for Health and Consumer Protection by 386 votes in favour, 281 against and 28 abstentions. Mr Borg was nominated by the Maltese government to replace Mr John Dalli, following his resignation as Health Commissioner. The vote in plenary took place after the hearing held by ENVI in association with IMCO and AGRI, on 13.11.12.
