On 19.12.2017, the EC published this proposal which is one of the two pillars of the “Goods Package”, adopted to strengthen the internal market for products, enhance free movement of goods within the EU and foster product compliance. The key objective of the proposal is to strengthen the checks made by national authorities and customs on products entering or circulating in the Single Market to prevent unsafe products from being sold to EU consumers. Targeted provisions were introduced by the EP

to clarify & strengthen the proposal, with the aim to achieve a more harmonised European approach on market surveillance, and ensure a higher level of cooperation among authorities. The EP introduced new provisions for market surveillance of products sold online, introduced a peer evaluation of market surveillance authorities, strengthened the role of Union Product Compliance Network, and clarified the obligations of person in the EU who could be contacted directly about compliance issues and would be obliged to ensure that any case of non-compliance is remedied. A transparent framework for cooperation between market surveillance authorities and economic operators was set up, together with an effective mutual assistance procedure between Member States.

The Regulation will be applicable to all non-agricultural products subject to the Union harmonisation legislation.

The Proposal was adopted by the EP on 17.04.2019 and is to be adopted by Council before being published in the OJ.
