Posting of workers in the framework of the provision of services
On 28.11.16, Members had their first exchange of views on the Commission proposal on the posting of workers, highlighting a rather wide spectrum of both concerns and expectations with regard to the tabled legislation. Some of the Members highlighted social aspects, like the need to reintroduce the old definition of remuneration, significantly shorten the time limit after which the temporary nature of provision of services terminates and it becomes a permanent activity.

Also the legal basis was touched suggesting to use Article 153 TFEU on protection of workers as additional one, and generally fight against the unfair competition and so-called social dumping was emphasized.

Other members stressedthe need to focus on the primary objective of the properly functioning SingleMarket, the free movement of persons in which constitutes a fundamental part;they stressed the need for provisions fighting the protectionist measures,expanding the focus beyond the construction sector, and tackling illegalactivities through enforcement measures rather than impeding the Single Marketby regulation that either blocks or discourages free movement and createsproblems of practical nature (like blocking internal corporate transfers). Dueregard should be given to the huge number of Member States which issued a"yellow card" for the subsidiarity issues with this proposal.

IMCO vote in Plenary on Union Customs Code
The European Parliament will vote on its report on Laying down the Union Customs Code (UCC), as regards goods that have temporarily left the customs territory of the Union by sea or air on 1st December 2016. The reformulated article 136 of the UCC would ensure effective application of custom supervision for goods that have temporarily left the Union customs’ territory, while moving by direct route between two points of that territory by sea or air without a stop outside the Union.

On 18.11.2015, the EC adopted a legislative proposal for amending the 91/477 Directive on Firearms, together with the overdue evaluation report and Implementing Regulation on deactivation. Among others, the EC proposal contains stricter rules to ban certain semi-automatic firearms and for the online acquisition of firearms; includes museums and collectors in the scope of the Directive; amends the authorisation conditions for acquiring and possessing a firearm (e.g. provision of a medical test).

It also proposes common rules on marking of firearms for traceability purposes and strengthens the exchange of information between MS.

The proposal lacks an Impact Assessment. As mentioned in an implementation appraisal published by EPRS, "the revision of the Directive was initially included in the Commission Work Programme 2016 (Annex I, item 17). Following the terrorist attacks in Paris on 13 November 2015, the publication of the Commission proposal was brought forward..." together with the Implementing Regulation on deactivation standards.

The Directive was reviewed in 2008 (IMCO Rapp.: G. Kallenbach/ Greens) and foresaw that the EC would submit an evaluation report by 28.07.2015 on the situation resulting from the application of the Directive, together with any appropriate proposals.

Union Customs Code Delegated Act
IMCO supported unanimously a draft motion for a resolution on tackling the challenges of the Union Customs Code implementation. The draft resolution calls for increased effectiveness of the regulatory framework and requests a thorough review to be made by the Commission of the whole policy area, as well as a fitness check and a new impact assessment.
