Approval and market surveillance of motor vehicles and their trailers
n December 2017, Parliament, Commission and Council reached a provisional agreement on the proposal in trilogue negotiations including, amongst others, to remove the proposed time limit on the validity of type-approval certificates, requiring Member States to provide sufficient funds for market surveillance activities and to finance type-approval activities from fees levied on manufacturers, empowering the Commission to carry out assessments of the procedures put in place by type-approval

authorities in Member States.

This agreement will be discussed in Plenary on 17 and voted on 18 April.

Approval and market surveillance of motor vehicles and their trailers
Parliament will discuss and vote the provisional interinstitutional agreement on the proposed legislation on approval and market surveillance of motor vehicles and their trailers, during its plenary sittings of 18-19.04.18. The text removes the time limit on the validity of type-approval certificates, requires Member States to provide sufficient funds for market surveillance activities, and empowers the Commission to carry out assessments of the procedures put in place, amongst other things.

Approval and market surveillance of motor vehicles and their trailers
Parliament voted on the provisional interinstitutional agreement on the proposed legislation on approval and market surveillance of motor vehicles and their trailers during its plenary sittings of 19.04.18. The new regulation on how cars are approved to go on the road and checked afterwards clarifies the responsibilities of national type approval authorities, testing centres and market surveillance bodies, in order to make them more independent and prevent conflicts of interest.

The Directive on Undertakings for Collective Investment in Transferable Securities (UCITS) provides for strong investor protection and creates a label for European retail investment funds. The Directive on Alternative Investment Fund Managers (AIFM) lays down rules for the authorisation, supervision and oversight of managers of non-UCITS funds, i.e. alternative investment funds (AIFs). Facilitating cross-border investment remains an essential part of the European Commission's action plan on building a capital markets union (CMU); the current legislative initiative is limited to facilitating further the cross-border distribution and supervision of UCITS and AIFs, mainly by reducing national regulatory barriers. This briefing presents the rationale for both the existing legislation and the new legislative proposal, as well as the positions of the institutional bodies and stakeholders.

The IMCO Committee will look into the amendments tabled to the draft report regarding the free flow of non-personal data on 24.04.18. The overarching aim of the Commission’s proposal is to unlock the potential of the EU data market by creating a more competitive and integrated internal market for data storage and processing services. At the heart of the proposal is a ban on national rules requiring data to be stored or processed in a specific Member State.
