Members considered the draft compromise amendments and had a last discussion before the vote on January 23. The Rapporteur presented the state of play on the 12 issues of the proposal where compromises have been discussed, and of which many are close to being finalised, including partial access, traineeships, professional card, and alert mechanism and language checks for health professionals. The Rapporteur identified the exclusion of notaries and the requirements for certain sectoral professions, such as nurses, as areas where further discussions are still needed before the vote.
 
Shadow Rapporteurs agreed with the Rapporteur's assessment with regard to notaries and nurses and acknowledged the difficulty in reaching a compromise regarding these topics. Other interventions focused on the particularities of traineeship contracts, the presumption of innocence regarding the alert mechanism for health professionals and the preference of measuring training requirements for sectoral professions on competences rather than duration. The Rapporteur and shadow Rapporteurs will continue with discussions in Strasbourg with a view to reach final compromises before the vote in Committee.

Members considered the compromise amendments reached on more than 990 amendments tabled.
 
Compromise proposals for the following areas were considered: simplification and flexibility of procedures; scope (definition of the concessions concept; exclusions); social requirements and procedural guarantees. The last Shadows meeting having taken place only the day before, compromises reached on some of the more controversial issues such as conditions for public-public cooperations, affiliated undertakings and governance were not considered in detail. The compromise on a potential increase of applicable thresholds is also still pending final verification of compatibility with EU international bilateral commitments.
 
Shadows generally expressed satisfaction with the results obtained, and thanked the Rapporteur for his open and professional management of this complex and controversial dossier. In particular, they welcomed the compromises aimed at simplifying the procedures and clarifying the scope of the directive (eg, stating the principle of administrative autonomy and freedom to define the provision of general services of economic interest, as well as exclusions). Reservations were raised with regards to the exemptions for public-public cooperations and affiliated undertakings. Overall however, most Groups recognised the importance of achieving a basic agreement on a common instrument, even if not all points of view could be reflected. Only the Greens stated their intention to vote against the report.
 
The vote in IMCO will take place on January 24th, on the same date as the vote on the directive on utilities.

The IMCO Committee is currently considering the Commission's proposals for a modernisation of the EU public procurement rules, including, more specifically, the revision of Directive 2004/18/EC ("Classic Directive") and of Directive 2004/17/EC ("Utilities Directive"). Public procurement is the process used by government institutions, public sector organisations and certain undertakings in the utilities sectors to buy supplies, services and public works. Such expenditure is a significant and influential component of the economy. The reform seeks to make the existing rules more flexible and easier to apply, to enable a greater strategic use of public purchasing power (to achieve green, social and innovation-related objectives) and to increase the use of new procurement techniques and tools such as joint buying and e-procurement. This work follows the adoption by the European Parliament of an IMCO own initiative report (rapporteur: Heide Rühle, Greens) in late 2011, in response to the Commission's Green Paper consultation.
 
The European Commission presented its proposal and the Impact Assessment to the IMCO Members on 9th January 2012. The first exchange of views took place on 29th February 2012.

Press release - Professional skills card will ease mobility in the EU, say internal market MEPs - Committee on the Internal Market and Consumer Protection

Professionals will find it easier to work in another EU country thanks to an electronic card detailing their qualifications and experience, said the Internal Market Committee on Wednesday, amending a new draft law on recognition of professional qualifications. MEPs also backed plans for an EU- wide alert system to prevent doctors or nurses who are barred from their profession in one EU country from exercising it in another.
