Members adopted (28 - 10 - 2) approximately 153 amendments, out of which the full 115 compromise amendments reached between Shadows and the Rapporteur. A motion for rejection of the legislative resolution was rejected (27 - 10 - 1).
 
The compromises adopted partly reflected those supported in the two public procurement directives ('classic' and 'utilities'), which were voted on 18 December 2012 and on 24 January respectively. These include, notably, a compromise on the provisions for public-public cooperation, affiliated undertakings and on exclusions as well as.
 
Coordinators will decide at a later stage whether to open negotiations with the Council for an early first-reading agreement on the entire public procurement package or to submit the IMCO reports to plenary.

Public procurement
Members voted by 25-5-8 on the proposal for a Directive on Procurement by entities operating in the water, energy, transport and postal services sectors ('Utilities directive'). Approximately 144 amendments were adopted, out of which the full 78 compromise amendments reached between Shadows and the Rapporteur (in total 1 004 amendments had been tabled).
 
The compromises adopted reflected those supported in the classic public procurement directive, which was voted on 18 December 2012. These include, notably, a compromise on a general principle on social and environmental considerations; on life-cycle costing; on subcontracting; on public-public cooperation and on exclusions as well as on the 'light regime' for social services.
 
Coordinators will decide at a later stage whether to open negotiations with the Council for an early first-reading agreement on the entire public procurement package or to submit the IMCO reports to plenary.

Members adopted by 33 votes in favour, 4 against and 2 abstentions the 150 amendments and 39 compromise amendments tabled.
 
The issues covered by the compromises include partial access to a regulated profession; traineeships; deadlines and tacit authorisation; alert mechanism and language checks for health professionals; continuous professional development; common training framework; notaries; delegated acts; European professional card; and sectoral professions such as doctors, nurses and architects.
 
Currently, the Report is scheduled for a Plenary vote in May. The Rapporteur and shadows will however consider the opportunity to open first reading negotiations at their next meeting.

Highlights - Action programme for customs in the European Union for the period 2014-2020 - Committee on the Internal Market and Consumer Protection

Customs
Members voted on the draft Resolution (as a whole) on the Customs programme for 2014-2020 by 34 votes in favour and one against.
 
On 18 December 2012, IMCO postponed this vote until the BUDG Committee confirmed which of its amendments on Fiscus programme could still be considered in IMCO on the Customs programme file.
 
Amongst others, the Report strengthens the objective of  fighting against fraud and specifies the other objectives to be included in the Regulation in order to increase its visibility and legal clarity.

Irish Presidency of the Council
Mr. Richard Bruton underlined the importance that his country attaches to creating the right conditions and environment in Europe in order to promote jobs and growth and to deepen the Single Market. In that context, the Minister assured Members that he would do his best to facilitate agreement between the Parliament and the Council on the remaining Single Market Act I (SMA I) files.
 
With regard to specific priority files, he referred to the three Public Procurement Directives, the Accounting Directive, Auditing measures and the proposals on Mutual Recognition of Professional Qualifications and Posting of Workers. The Presidency also aims to reach agreement with the Parliament on the Union Customs Code and to finalise work on the Consumer Programme 2014-2020.
 
Looking forward to Commission's proposals of the SMA II files, the Minister committed to advance them as far as possible at Council preparatory bodies. He also indicated that the Presidency will seek to advance measures which help to build the Digital Single Market and build confidence in cross border transactions. Maximising the potential and benefits of the Services Directive, as well as tackling red tape and promoting smart regulation will also figure among the Presidency priorities.

Alongside the on-going reform of public procurement, the IMCO committee is currently considering a Commission proposal on concessions contracts. This initiative seeks to ensure a more efficient allocation of public money by establishing a single instrument regulating the competitive award of concessions contracts. The proposed rules seek to increase legal certainty for public authorities and to guarantee businesses effective access to the concessions markets across the EU.
 
The European Commission presented its proposal and the Impact Assessment to the IMCO Members on 25h January 2012. The first exchange of views took place on 29th February 2012.
