Highlights - Online gambling in the internal market - Committee on the Internal Market and Consumer Protection

Online gambling
On 20 February AM, Members had an exchange of views on the own-initiative report on online gambling in the internal market. Fair offer of gambling services is necessary for consumer protection because in its absence consumers are more likely to turn to unreliable and non-credible gambling websites falling outside of the remit of public oversight and regulation.

The Rapporteur opened up the debate by asserting that the only way to approach regulation in this field is by trying to achieve a certain level of harmonisation throughout the EU, while still respecting the principle of subsidiarity. The main axes of his draft report were said to focus on the enforcement of EU law, the enhancement of administrative cooperation, e.g. through a common identification system and self-blocking mechanisms, consumer protection, responsible advertising and actions aiming at combating money laundering and ensuring the integrity of sports.
 
EPP and S&D shadows emphasised the need to respect the different regulatory approaches of Member States in a sector of economy which does not resemble ordinary economic activities, while they welcomed the Commission's suggested actions regarding administrative cooperation, consumer protection, sports integrity and money laundering. ALDE shadow said that the Commission's Communication was not ambitious enough and that legally binding measures are necessary at EU level, while Greens shadow concluded that Member States have failed to achieve what is necessary to protect consumers, especially with regards to advertising. Deadline for amendments: 4th April 2013.

Implementing the Services Directive: lift-off for mission growth
The hearing focused on two main elements: how to remove barriers and unleash growth in services and how to maximise the economic effects for consumers and businesses, keeping up with innovation. Stakeholders representing business, academia, consumers and trade unions provided input on a number of subjects and entered into a lively debate with Committee Members.
 
There was a broad consensus that a better implementation of the Services Directive could have a significant impact on the creation of jobs and growth, by bringing both domestic and EU-level reform of the services sector. As the rapporteur, Mrs Corazza-Bildt, stated, the EU could gain up to 2,6% of GDP over the next 5 to 10 years if the Services Directive were enforced properly. As experts and members stressed, however, it was equally important to ensure a good interplay with other pieces of legislation affecting the services sector, such as the recognition of professional qualifications, the eCommerce Directive and matters governing the posting of workers. Other points emphasised include the importance to overcome remaining barriers, to ensure the single market works effectively for consumers and to move towards 2nd generation "Points of Single Contact". Several MEPs also voiced concerns about social aspects and workers rights in relation to the services sector and urged MEPs not to overlook the social dimension in our efforts to overcome the crisis.

The rapporteur called for a concerted effort to reach a Consumer agenda which is agreed by all based on the 213 amendments submitted to the draft report. The Shadow rapporteurs have divergent views on the approach to be adopted to offer protection to consumers. On one hand, it is felt that that best protection offered is providing the consumer with information to empower the consumer. This could be done by promoting internet portals for more awareness such as Your-Europe. Consumer safety and security is paramount but these should not create obstacles to trade. On the other hand, others felt that without the adequate tools such as proper enforcement, redress (including collective redress) and a sound financing of consumer organisations, to ensure that they build their capacity to defend consumers rights, as simply informing the consumers would not be sufficient.
 
The rights of consumers are not only about consumers per se, but companies need to be targeted too. Attention needs to be paid to competition policy and what can be perceived as unfair competition both in the offline as well as in the online world. This links also with what is being currently discussed on the proposed regulation on data protection. Consumer data is used increasingly as the new currency between companies without necessarily requesting a clear prior consent to consumers. Better use of the data in the Consumer Conditions and Consumer scoreboard needs to be made to ensure a proper and scientific information flow on consumer issues and market surveillance matters.

The IMCO Committee is currently considering the Commission's proposals for a modernisation of the EU public procurement rules, including, more specifically, the revision of Directive 2004/18/EC ("Classic Directive") and of Directive 2004/17/EC ("Utilities Directive"). Public procurement is the process used by government institutions, public sector organisations and certain undertakings in the utilities sectors to buy supplies, services and public works. Such expenditure is a significant and influential component of the economy. The reform seeks to make the existing rules more flexible and easier to apply, to enable a greater strategic use of public purchasing power (to achieve green, social and innovation-related objectives) and to increase the use of new procurement techniques and tools such as joint buying and e-procurement. This work follows the adoption by the European Parliament of an IMCO own initiative report (rapporteur: Heide Rühle, Greens) in late 2011, in response to the Commission's Green Paper consultation.
 
The European Commission presented its proposal and the Impact Assessment to the IMCO Members on 9th January 2012. The first exchange of views took place on 29th February 2012.
