Electronic invoicing in public procurement
The IMCO Committee has considered the Commission's proposal on electronic invoicing ('e-invoicing') in public procurement. The proposal seeks to establish a common EU-wide standard for e-invoices that all contracting authorities and entities must accept, even though they may continue to use other national standards and systems. This complemented the package for the modernisation of the EU public procurement rules, adopted in plenary in January 2014, which makes use of e-procurement procedures mandatory by 2018. The proposal is also one of the first to apply standardisation regulation 1025/2012/EU.
 
Public procurement is the process used by government institutions, public sector organisations and certain undertakings in the utilities sectors to buy supplies, services and public works. Such expenditure is a significant and influential component of the economy. The procurement package strengthens the rules for electronic procurement, making its use mandatory at the latest 54 months after the entry into force of the revised instruments. Moving towards more efficient paperless procedures is expected to yield great benefits. However, the modernisation package does not cover the 'post-award' stage of invoicing, because it is not procurement-specific. The e-invoicing directive seeks to fill this gap, as e-invoicing in particular is expected to generate tangible financial savings for government and suppliers, and to promote digital business transactions throughout the EU, by ensuring that there are no interoperability barriers to cross-border trade.
 
The European Commission presented its proposal and the accompanying Impact Assessment to IMCO Members on 30 September 2013. This was followed by an exchange of views on 4 November 2013 and the consideration of both, amendments and compromise amendments on 16 December 2013. On 17 December 2013, IMCO adopted the proposal by 37 votes in favour, and gave the green light to opening informal trilogue negotiations with the Council. The negotiations were successfully concluded at early first reading with the confirmation of the agreement by COREPER I at the end of January 2014 and IMCO endorsement on 11 February. The adoption in plenary is scheduled for March 2014.

This briefing note deals with the data protection aspects of the Commission’s Proposal for a Regulation of the European Parliament and of the Council concerning type-approval requirements for the deployment of the eCall in-vehicle system and amending Directive 2007/46/EC COM(2013) 316 final. It explains why the eCall system entails the processing of personal data. It deals with the data protection issues both for the mandatory 112-based eCall in-vehicle system as well as additional private emergency and added value services offered in parallel or building on the public 112-based eCall.

Seminar on Health and consumer protection
In close cooperation with the ENVI and IMCO committees, the EP's Unit for Pre-Accession Actions has prepared a Seminar on Health and consumer protection which took place on 19 and 20 February 2014. Delegations from the 6 parliaments of Western Balkans (Albania, Bosnia and Herzegovina, former Yugoslav Republic of Macedonia, Kosovo, Montenegro, Serbia) and Turkey came to the EP for an exchange of views and best practices with MEPs and representatives of the European Commission and other institutions.

The legislative reports on the deployment of the eCall in-vehicle system and on the accessibility of public sector bodies’ websites will be voted on by the European Parliament during its plenary sitting of 26.02.14. The non-legislative report on Single Market governance within the European Semester will be voted the same day, while the one on SOLVIT – the out-of-court problem solving network for the misapplication of Internal Market law by public authorities – will be voted on 27.02.14.

The draft Radio Equipment Directive lays downs harmonised ruled for placing on the market of the radio equipment and includes essential requirements for the protection of health and safety, of electromagnetic compatibility and for the avoidance of harmful interference.
 
The scope of the Directive has been extended to include all radio receivers, however it has been restricted to radio equipment capable of radio communication or radio determination only. An explicit reference to the common chargers for particular categories or classes of radio equipment has been included into the text. In order to improve the level of compliance the registration of radio equipment within some categories has been approved.
 
The political agreement has been reached in December 2013 and subsequently approved by the COREPER and the IMCO Committee in January 2014. Provisionally the draft Directive should be voted in March plenary.

On 11 May 2011, the Parliament endorsed the agreement reached with the Council by the IMCO negotiators on a new regulation which lays down rules concerning the use of textile fibre names and related labelling and marking of fibre composition of textile products. It also set rules concerning the labelling or marking of textile products containing non-textile parts of animal origin, as well as rules concerning the determination of the fibre composition of textile products. The general objectives are to improve the functioning of the internal market and to provide accurate information to consumers.

The Services Directive has been a key tool to promote structural reform in the services sector. However, it is still not fully implemented and correctly applied in all Member States as businesses continue to face an accumulation of red tape, discriminatory practices and barriers that hamper the free movement of services.
 
IMCO has actively followed the implementation of the Services Directive and has led three own-initiative reports on the matter, notably:
 
- The Internal Market for Services: State of Play and Next Steps (2012/2144(INI)), Anna Maria CORAZZA BILDT, EPP
- Mutual Evaluation Process of the Services Directive (2011/2085(INI)), Malgorzata HANDZLIK, EPP
- Implementation of the Services Directive 2006/123/EC (2010/2053(INI)), Evelyne GEBHARDT, S&D
 
The latest resolution, adopted by plenary on 11 September 2013, argues that by unleashing remaining barriers and administrative burdens in the services sector, the EU could make an economic gain of up to 2,6% of GDP in the next 5 years. The resolution regrets the "significant numbers of identified cases where Member States are inappropriately invoking overriding reasons of public interests" for the sole purpose of "protecting and favouring their domestic markets". IMCO  will continue following the work of the Commission in this domain, including in particular the latest initiative launched on 2 October 2013 of Member States together with the Commission assessing barriers restricting access to and exercise of regulated professions (professions to which access is conditional upon the possession of specific qualifications or for which the use of a specific title is protected, e.g. pharmacists or architects, see below on the revised directive on professional qualifications).

Despite efforts over the last ten years to liberalise and integrate the telecommunications market, Europe is still fragmented into 28 separate national communications markets, each with a limited number of players. To overcome this problem, in September 2013 the Commission has put forward a package of proposals to reform the European telecoms market, including a proposal for a regulation. This current patchy scenario raises barriers and increases the costs for operators wanting to provide cross-border services thereby impeding their expansion. EU rules on, for example, authorisations, regulatory conditions, spectrum assignment and consumer protection are implemented in diverging ways. As a consequence, while no operator is present in more than half of the Member States at best, overall more than 200 operators serve a market of 510 million of customers. This stands in stark contrast with the US or China who have one single market of 330 and 1400 million customers respectively, served by four to five large operators, with one legislation, one licensing system, and one spectrum policy. The untapped potential of an EU single market in electronic communications is estimated at up to 0.9% GDP, or EUR 110 billion per year. The benefits from a single market for business communication services alone amount to almost EUR 90 billion per year. To benefit from this untapped potential the proposed regulation builds upon and advances the main directives of 2002 governing the provision of electronic communications, as amended in 2009, by introducing directly applicable legislative provisions which shall operate in conjunction with the provisions of the existing legislative package. On 23 January 2014, the IMCO Committee adopted the draft opinion of Mr Harbour on the proposed regulation on a European single market for electronic communications. The opinion diverts significantly from the Commission's original approach of fully harmonising consumer rights provisions through the regulation and instead introduces valuable new provisions through amending the Universal Services and Users' Rights Directive.

In January 2013 the European Commission tabled a proposal for a directive concerning measures to ensure a high common level of network and information security across the Union. This proposal was presented in connection with the joint Communication of the Commission and High Representative of the Union for Foreign Affairs and Security Policy on a European Cybersecurity Strategy. The objective of the Strategy is to ensure a secure and trustworthy digital environment, while promoting and protecting fundamental rights and other EU core values. IMCO issued a report on the directive, while ITRE and LIBE committees have been associated under Rule 50 (exclusive competence) on certain provisions, which were voted in January 2014 in the committee, with the aim to reach the EP position in the first reading in April 2014. The negotiations with the Council will start most probably during the Italian Presidency.

Simplifying the transfer of motor vehicles registered in another MS within the Single Market addresses the issue that notwithstanding the progressing integration of the single market, motor vehicle registration problems remain a frequent obstacle for citizens when exercising their rights under EU law in their daily lives. To address those problems, on 4 April 2012, the Commission presented a legislative proposal aimed to harmonise, streamline, and simplify the procedures for re-registration of motor vehicles registered in another Member State. On this basis, on 9 July 2013 IMCO adopted a report , which seeks to further simplify the vehicle registration formalities and conditions. Following a slow progress in the Council, IMCO decided to enter informal negotiations with a view of reaching agreement with the Council on 23 January 2014 . On 31 January 2014, a majority of Member States have requested however an impact assessment on the taxation aspects of this proposal before continuing work on it. Therefore, the Presidency has suspended its negotiations as it could not get an informal mandate to proceed.

The Alignment Package consists of nine directives being aligned to the 'New Legislative Framework' (NLF) which was adopted as part of the goods package from 2008, in particular decision No 768/2008/EC establishing a common framework for the marketing of products. The NLF sets out the reference for future product legislation and the 9 directives were chosen as they were not foreseen for revision in the coming years. The directives were aligned to the NLF through a recast technique, seeking to focus only on changes that were a direct result of the alignment procedure without going into substantive changes that would require longer preparations.
 
The final agreement with the Council leads to less red tape for economic operators, better market surveillance and clearer labels for consumers. The most sensitive issue during the informal negotiations with the Council was the Council's wish for adding committee procedures to all the directives.
 
The Directive on Pressure Equipment was separated from the Alignment package presented in November 2011 because, unlike the other nine Directive, this recast also contained an alignment with another EU legislative act, namely Regulation (EC) No 1272/2008 (CLP Regulation) of the EP and of the CEU of 16 December 2008 on classification, labelling and packaging of substances and mixtures. The intention of the proposal was restricted to a pure alignment with the horizontal provisions in Decision 768/2008/EC and CLP Regulation as well as the new terminology within the Lisbon Treaty, including new rules on Comitology.
 
The IMCO Members supported the Commission's general intention of a pure alignment and had therefore limited their amendments to the EC proposal to changes reflecting the agreement obtained between the Council and the Parliament on the nine other Directives and which had been omitted in the proposal. The Greek Presidency got a mandate on 22 January and the second trialogue was held on 5 February 2014.

Mutual assistance to ensure the correct application of the law on customs and agricultural matters
On 3 March PM, Members will discuss the 76 amendments tabled to the draft report on Mutual assistance to ensure the correct application of the law on customs and agricultural matters. In particular the Rapporteur proposes to strengthen the security of the internal market and the products circulating within it, while at the same time providing consumers with a high level of protection. To do so, the Rapporteur proposes concretely that the Commission be granted the prerogative of directly contacting economic agents, subject to prior notification of the national authorities, who are given two weeks within which to answer. He also seeks to prevent infringers from taking advantage of the rules specific to each Member State concerning the barring of legal action. Vote in Committee: 18 March 2014.
