Pietikainen and Schaldemose - Product Safety and Market Surveillance
On 13 February 2013 the European Commission adopted a comprehensive package on Product Safety and Market Surveillance in order to improve safety of consumer products, in particular by strengthening product identification and traceability, and to simplify and improve the framework of market surveillance of products, particularly by eliminating currently existing overlaps and inconsistencies. The package, which is a key action of the Single Market Act II, consists of two legislative initiatives: a proposal for a new Regulation on Consumer Product Safety and a proposal for a single Regulation on Market Surveillance of Products, as well as complimentary non-legislative measures, in particular multi-annual plan for market surveillance setting out 20 actions to be implemented until 2015 to make progress in market surveillance.
 
Two legislative proposals and the accompanying impact assessment have been presented in IMCO Committee on 7 May 2013 and Members held a first exchange of view at the same day. The Committee is organizing a hearing on the subject entitled "Safe Products and a Fair Market: Challenges and Opportunities" on the 29 May 2013.

The draft Radio Equipment Directive lays downs harmonised ruled for placing on the market of the radio equipment and includes essential requirements for the protection of health and safety, of electromagnetic compatibility and for the avoidance of harmful interference.
 
The scope of the Directive has been extended to include all radio receivers, however it has been restricted to radio equipment capable of radio communication or radio determination only. An explicit reference to the common chargers for particular categories or classes of radio equipment has been included into the text. In order to improve the level of compliance the registration of radio equipment within some categories has been approved.
 
The political agreement has been reached in December 2013 and subsequently approved by the COREPER and the IMCO Committee in January 2014. Provisionally the draft Directive should be voted in March plenary.

Mutual assistance to ensure the correct application of the law on customs and agricultural matters
On 3 March Members discussed the 76 amendments tabled to the draft report on Mutual assistance to ensure the correct application of the law on customs and agricultural matters. In particular the Rapporteur has proposed to strengthen the security of the internal market and the products circulating within it, while at the same time providing consumers with a high level of protection. To do so, the Rapporteur has proposed concretely that the Commission be granted the prerogative of directly contacting economic agents, subject to prior notification of the national authorities, who are given two weeks within which to answer. He also seeks to prevent infringers from taking advantage of the rules specific to each Member State concerning the barring of legal action. Vote in Committee: 18 March 2014.

On 3 March PM, Members will vote on the 156 amendments tabled to this INI draft report. The majority of the AM underline the importance of utility service and the significance of the protection of consumers' rights, while also acknowledging the value of the existing legislation covering notably Telecoms, Energy and Postal Services. They also stressed the importance of the competences of the Member States in that regard and their role in enforcing the legislation.

The Impact of the TTIP on the Internal Market
On 17 March PM, IMCO will hold a hearing on the Impact of the Transatlantic Trade and Investment Partnership (TTIP) on the Internal Market. The first panel will assess the challenges of regulatory cooperation while the second one will tackle the question of divergent EU and US standards and legislation governing public procurement. Deadline for registration: 11 March at 12.00.

On 3 March, IMCO adopted with 27 votes in favour, 2 votes against and 1 abstention the INI report of MEP Josef Weidenholzer (S&D). The 17 compromise amendments prepared, take into account the comments of the shadows, notably to remove any reference to the need for further legislation at EU level and specific comments related to the Internal Energy Market and the Postal Services. All CAs have been endorsed during the vote. Vote is plenary is foreseen in April II.

To help mitigate the consequences of serious road accidents, the EU has committed to putting in place an emergency call system known as eCall. Based on in-vehicle communication technology, such an electronic safety system will automatically call emergency services in case of a serious crash. The eCall will dial 112 - the Europe's single emergency number and communicate the vehicle's location to emergency services, even if the driver is unconscious or unable to make a phone call. It is estimated that it could save up to 2500 lives a year.
 
To achieve that objective, on 13 June 2013 the Commission presented two legislative proposals aimed at ensuring that, from 1 October 2015, firstly, all new models of passenger cars and light duty vehicles would be fitted with 112 eCall and, secondly, the necessary infrastructure would be created for the proper receipt and handling of eCalls in emergency call response centres - ensuring the compatibility, interoperability and continuity of the EU-wide eCall service.
 
These proposals have been requested by the Parliament, in particular, in its resolution of 3 July 2012 on e-Call: a new 112 service for citizens (IMCO-TRAN report under Rule 51 by Olga Sehnalová and Dieter-Lebrecht Koch).
 
Out of the two proposals, the one concerning the deployment of the necessary infrastructure is discussed by the TRAN Committee, with Philippe De Backer (ADLE) as Rapporteur, while the IMCO Committee is the lead committee for the proposal concerning the in-vehicle equipment - the proposed regulation on type-approval requirements for the eCall in-vehicle system and amending Directive 2007/46/EC.
 
The proposal for a regulation provides for the mandatory introduction of an eCall in-vehicle system in new type-approved vehicles across the EU. Contrary to the current system where eCall is installed by manufacturers on a voluntary basis, the proposal provides for a mandatory fitting of eCall devices in vehicles, starting with new passenger cars and light commercial vehicles, by 1 October 2015. It therefore requires vehicle and equipment manufacturers to ensure that, in the event of a severe accident, an eCall to 112 is activated automatically. An eCall can also be triggered manually. Furthermore, the regulation provides for rules on privacy and data protection, as well as for the delegation of powers to the Commission in respect of detailed technical requirements.
 
The Parliament adopted its position at first reading on 26 February 2014.

Alongside the on-going reform of public procurement, the IMCO committee considered the Commission proposal on concessions contracts. This initiative sought to ensure a more efficient allocation of public money by establishing a single instrument regulating the competitive award of concessions contracts. The proposed rules aimed at increasing legal certainty for public authorities by establishing for the first time EU wide rules to define the notion of risk and affirm important principles, such as free administration and services of general economic interest.
 
In order to guarantee to businesses effective access to the concessions markets across the EU for both works and services, while also ensuring an overall economic advantage for public authorities, the directive provides that concession award criteria must be objective and that social and environmental considerations should also be taken into account in a determinative fashion.
 
Council and Parliament agreed to totally exclude the water sector from the new rules. Some other services of a specific nature, such as certain lotteries, civil defence and protection, emergency services performed by non-profit organisations, and media, financial or legal services, were also excluded from the scope of application of the new directive.
 
The European Commission presented its proposal and the Impact Assessment to the IMCO Members on 25h January 2012, while the whole of the parliamentary works were completed within a period of 2 years: The negotiations were successfully concluded at first reading with the confirmation of the agreement by COREPER I in July 2013 and IMCO endorsement on 5 September 2013. The full modernisation package, including the concessions directive, was adopted by Parliament in a plenary vote on 15 January 2014, and by Council on 11 February 2014. Publication in the official journal is expected to take place on the 18th of March, with the directive entering into force on the 28th of March 2014.
